Debt Recovery Fees

At Markand & Co Solicitors, we provide transparent, fixed-fee solutions for debt recovery services, giving you certainty over costs from the outset.

The below table sets out our fees and costs associated with a claim issued at the Court Money Claims Centre. These costs apply where your claim is in relation to an uncontested invoice and enforcement action is not required. If the other party dispute your claim, we will discuss any further work and advise you on costs.

Costs, Scope of Work and Key Information

Disbursements may include counsel’s fees, court fees, and postage.

If you wish to proceed with a claim, please note the following:

• The 20% VAT element of our fee cannot be reclaimed from your debtor.
• Interest and compensation may increase the total debt, which could move the claim into a higher banding and result in higher costs.
• The costs quoted above do not include matters where enforcement action (such as instructing a bailiff) is required to recover the debt.

Our fee includes:

• Taking your instructions and reviewing documentation
• Undertaking appropriate searches
• Sending a letter before action
• Receiving payment and forwarding it to you, or if the debt is not paid, drafting and issuing a claim
• Where no Acknowledgment of Service or Defence is received, applying to the court for judgment in default
• Upon receiving judgment in default, writing to the other side to request payment
• If payment is not received within 14 days, providing advice on next steps and likely costs

Matters usually take between 6–12 weeks or longer, depending on the value of the claim, from receipt of your instructions to receipt of payment from the other side. This timeframe assumes the other party pays promptly following judgment in default. If enforcement action is required, the matter will take longer to resolve.
